Canadian Fiddler Seeks $1.5 Million After Google AI Overview Misidentifies Him as Sex Offender

The complaint alleges that Google's AI-generated summary feature, "AI Overview," incorrectly identified MacIsaac as a sex offender with multiple criminal convictions. Specifically, it stated that he had been convicted of sexual assault of a woman, online enticement of a child for the purpose of sexual assault, and assault causing bodily harm. It also falsely claimed that he was on a national sex offender registry for life.

MacIsaac asserts that Google is responsible for the damages resulting from design flaws in AI Overview. The complaint states, "Google knew, or should have known, that AI Overview was imperfect and could return information that was not true."

The damages are broken down into $500,000 each for general, aggravated, and punitive damages. According to MacIsaac, a concert scheduled for December 19 at the Sipekne’katik First Nation was canceled following complaints from the general public. The First Nation later issued a public apology, explaining that the cancellation was caused by false information generated via AI-powered search.

MacIsaac stated that learning about this misinformation caused him to feel a concrete fear of stepping onto a stage. The lawsuit also points out that Google failed to contact or apologize to him. Furthermore, he argued that "punitive damages would be awarded if human reporters had made these false claims," asserting that Google's liability should not be mitigated simply because the information was published by software.
